1. General Provisions 1.1 Labour, academic and disciplinary relations between the administration, academic and support staff and the students of the Academy of Economy and Law (afterwards “the Academy”) are regulated by the Interim Code of Conduct, the Labor Code of Georgia and “Law on Higher Education” 1.2 Interim Code of Conduct defines the staff recruitment procedures, code of ethics and basis and rules for disciplinary responsibility that is obligatory for the persons working at the academy and for the Academy Students.
2. Labour Relations with the Academic and Administrative Staff 2.1 Election/approval on the administrative position is regulated by the University Constitution 2.2 Election on the academic position (post) is held by the Ruling Council according to the rules defined by the Article 35 of Law of Georgia “on higher education”. Additional conditions may be prescribed by the Ruling Council, by the introduction of the Dean of the appropriate faculty. 2.3 Administrative and Academic positions and their number are defined according to the staff schedule that is approved by the President of the Academy 2.4 Early dismissal from the administrative and academic position is possible by the decision of the Ruling Council, according to the background prescribed by the legislation and the Interim Code of Conduct of the Academy.
3. Labour Relations with the Support Staff 3.1 Labour relations with the support staff are established on the basis of the contract, on the units provided for the staff schedule and or as a contractor. 3.2 The number and the personnel and the composition of the staff is defined due to the organizational, business and other needs of the Academy. Vice-President of the Academy coordinates staff issues and the functions of the support staff. 3.3 Each staff member duties which are related to his/he work are defined by the agreement.
4. Staff Discipline and Responsibility 4.1 The staff working at the academy has the duty to accomplish its functions honestly, proficiently, and in a timely manner, to defend the rights and legal interests of others, to report at work on time, to take care of the property of the Academy. 4.2 The violation of the requests of point “4.1”, exceeding or abusing one’s powers, immoral misconduct, missing working hours without good reason will cause disciplinary responsibility of the person. 4.3 The issues of disciplinary responsibility of the staff are discussed by the Ruling Council and the decision is formed by the Order of the Rector. 4.4 Disciplinary proceeding, also estimation disciplinary misconduct, the measure of penalty and the terms of its usage are defined by the Labour Code of Georgia and the Interim Code of Conduct of the Academy. 4.5 The issue of non-qualified leading of the function assigned to the staff is also discussed According to the disciplinary proceeding 4.6 Collegial discussion of the Disciplinary issue is held by the Ruling Council, due to the written mediation of the Council Member. 4.7 The reason of the beginning of the disciplinary proceeding may also be the report of the other staff member or the student. Denial on the beginning the disciplinary proceeding must be well-founded. 4.8 Before the essential discussion of the issue the individual is given the opportunity to provide the explanation in written form or orally – at the meeting of Ruling Council that is noted in the minute. 4.9 Council may listen to the explanations of other individuals or ask for them in written form, concerning the misconduct that should be discussed 4.10 The Council decision is formed by the Order of the President 4.11 The Rector is authorized to change the Council’s decision. This decision should be motivated. 4.12 The copy of Order about the using the disciplinary penalty is delivered to the individual who is charged.
5. Rights and Responsibilities of the Student 5.1 The rights and responsibilities of the student are defined by the Georgian Law “On Higher Education”, Academy Constitution and Interim Code of Conduct 5.2 Student has the right to receive the information, get acquainted with the documents, concerning his/her rights, interests as well as inside the Academy also the rules and news in the higher education system, use the educational-material resources of the Academy 5.3 It is allowed to establish Student Self-governance at the Academy 5.4 The duties of the student are: a) To obey the Interim Conduct of the Academy, study schedule, Orders of the President, Code of ethics of the Student and other manuals. b) To defend the public order c) To obey the fair claims, remarks (notices) and indications of others. d) To use the principles of honest competition to achieve the Academic excellence e) To take care of equipment and other property of the Academy f) Not to discredit the reputation of the Academy by his/her actions.
6. Student Responsibility 6.1 The disciplinary misconduct may include: a) Missing the study hours without a good reason b) Being at the Academy or outside of it during the study hours under the influence of alcohol or drugs. c) Bringing and keeping the subjects, substances that are out of civil circulation on the territory of Academy. d) Any act of physical and psychological violence, offence on other individuals also rude insubordination to the fair claim of the Academic Staff e) Intentionally or recklessly damaging or destroying the Academy’s equipment and other material goods. f) Other matters prescribed by Code of ethics.
6.2 The forms of disciplinary penalties and disciplinary proceedings are defined according to the Coe of Ethics 6.3 Expulsion of the student from the Academy may occur due to the decision of the Ruling Council, for rude misconduct or misconduct done after the warning, also in case of imposing administrative or criminal penalty upon him/her 6.4 Expulsion form the Academy may occur in case of Academic decrease or in case of non-payment of the tuition fees. 6.5 Property damage caused by the misconduct will cause the material responsibility of the student.
7. The Principles and Subjects of discussion of the student disciplinary responsibility 7.1 The issue of students’ disciplinary responsibility as well as withdrawing the disciplinary penalty is discussed by the Faculty Council 7.2 The authority of the Ruling Council in the disciplinary proceeding is defined by the Interim Code of the Academy and Code of Ethics. 7.3 Disciplinary hearing is held after studying all the circumstances related to the misconduct 7.4 The body of disciplinary hearing makes a decision about the issue of choosing and using the disciplinary penalty, or about canceling the disciplinary hearing. The decisions of the Council must be well-founded. 7.5 The body of disciplinary hearing defines the heaviness and content of the misconduct, qualifying signs of misconduct may be well-founded. 7.6 The Disciplinary proceeding is defined by the Code of Ethics 7.7 The Decision about using the disciplinary penalty is formed by the Order of the President.
