Chapter I General Provisions 1. This constitution defines the goals and tasks of Tbilisi Academy of Economy and Law, its organizational structure, and responsibilities of structural units. 2. The constitution corresponds to the Law on Higher Education of Georgia and to the other legislation. Chapter II Goals and Tasks of the Academy 1. The goals and tasks of the Academy are: a. To offer students high quality competitive higher education; b. To promote the formation of Georgian and World Cultural values, the orientation of ideals of democracy and humanism, that are obligatory for existence and development of Civil Society; c. To satisfy the requirements (aspirations) of the students to receive the higher education appropriate to their personal interests and opportunities (possibilities), to upgrade their qualification and retraining; d. To realize the personal potential of the student, to develop his/her creative skills, to prepare the persons having the competence responding the modern requirements, assure the competitiveness of the graduates on the internal and foreign labour markets, to offer to the interested persons the high quality higher education responding the requirements of the students and the society; e. Implementation and usage of high technologies in the process of obtaining of the higher education. f. Consideration/ implementation of the requirements and recommendations prescribed by the international documents of the Bologna Process. g. To provide and assure all interested candidates with individual studying programs, part-time, distance learning, or other allowed forms of teaching methodology. Chapter III The Organizational Structure of the Academy 1. The Academy comprises of the management structural units and the main educational units – Faculties and the Library of the Academy; 2. The authorities of the structural and educational units of the Academy are prescribed by this constitution; 3. The Academy is made up of the following administrative and management bodies (subjects): a. President of the Academy – Head of Administration (Rector); b. Vice-President of the Academy in financial, material and HR fields – Pro-rector; Vice-President of the Academy in PR field – Pro-rector; c. Advisory Board of the Academy d. Quality Assurance Service e. Administration Service of the Academy (Supplement #1). 4. Academy consists of two educational, educational-scientific units – the faculties of Law and Business Administration. 5. In the scopes of this constitution the Academy is implementing certification in the fields of business administration and law. Those who attend the courses will receive a certificate without an academic grading and a certification of professional achievement. These courses are functioning on the bases of human and material resources of the Academy. The number of course contingents, the price of the service, organizational and material assurance, and the regulation of integral relationships are the competence of the rector and vice-rector of the Academy. Chapter IV Principles of the Management of the Academy 1. The principles of the management of the Academy are: a. Accessibility for all students (society) to the decisions, orders, reports and other public documentation of the Academy; b. Academic freedom of academic personnel, students and course listeners; c. Involvement of academic personnel, students and course listeners in decision-making; d. Equal treatment for all, including the students and the academic personnel; e. Fairness and transparency of elections and the publicity of competitions held at the Academy Chapter V President of the Academy (Rector) 1. Head of the administration of the establishment of higher education. 2. The President of the Academy is the highest academic and administrative authority of the Academy, who represents the Academy in academic and research spheres both domestically and internationally and be entitled to enter into agreements and make deals on behalf of the Academy including financial and economic agreement. 3. President of the Academy assures the protection of cooperative and educational interests of the Academy. During the implementation of his/her authorities she guides with cooperative, civic, educational and other laws which are in force. 4. The President of the Academy appoints and relieves deans and other administrative/academic staff of the Academy. 5. The President of the Academy is appointed by the partner/partners, founders of the society. 6. The President of the Academy issues the orders which are mandatory for fulfilment for the academic personnel and students. 7. The President of the Academy implements co-operation according to the regional principle. Chapter VI Vice President (Pro-rector) of the Academy in Financial, Material and HR Fields 1. The Vice-President of the Academy is the highest administrative manager at the Academy in the financial, material and human resources fields and represents the Academy in financial and economic relationships; 2. The Vice-President is appointed by the President of the Academy. At the same time the Vice-President is the Deputy Head of the Advisory Board. 3. Vice President a. May enter into financial and economic agreements on behalf of the Academy as prescribed in the budget of the Academy; b. Defines and proposes to the President of the Academy for approval the support personnel recruitment procedures, amount and terms of remuneration; c. Bears responsibility for lawfulness and efficiency of the Academy’s financial and economic activities; d. Performs the authorities of the President of the Academy in case of non-performance of president’s authority or in case of his/her absence. e. Implements other functions as defined by the constitution. Chapter VII Vice President (Pro-rector) of the Academy in PR Field Vice President of the Academy is the administrative post, which represents Academy in relationship with the public and other third person; The President of the Academy appoints and relieves the Vice-President. Vice President: Is authorized to represent Academy in relations with press and other mass media; Is responsible for the relationships with other educational institutions and educational projects; Fulfils other additional functions of the public relations. Chapter VIII Advisory Board of the Academy 1. Advisory Board of the Academy is the counsel body of the Academy, which works out recommendations for the farther progressive development of the educational institution. 2. Advisory Board of the Academy consists of six members: a) President of the Academy – Chairmen of the Advisory Board; b) Chairman of the Student’s Union – Member of the Advisory Board; c) Vice-President of the Academy in Financial, Material and HR fields – Deputy of the Chairman of the Board ; d) Vice-President of the Academy in Public Relation Field (Pro-rector); e) Head of the Quality Assurance - Member of the Advisory Board; f) Dean of Business Administration Faculty – Board Member g) Secretary of the Board – a member of the administration appointed by the Deputy Chairman. 3. Advisory Board takes decision by simple majority of votes; 4. In case of even distribution of votes (cons and pros), Chairman of the Board’s decision prevails; 5. In case of absence or until election of the Chairman of the Student’s Union, Advisory Board is chaired by the Deputy Chairman; 6. According to this Charter, Advisory Board: a) Develops the Charter of the Academy and submits it to President for approval; b) Elaborates and drafts changes and addenda in the Charter of the Academy and submits them to President for approval; c) Elaborates and approves draft of Code of ethics of Academy and Disciplinary Norms; d) On the basis of proposal submitted by Vice-president, elaborates the project of administrative structure of the Academy, submits recommendations on creation, restructuring and abolishment of educational departments, stages and forms; e) Submits proposals on terms and procedures for selection and recruitment of academic personnel; f) Conducts hearings of reports from the Head of Quality Assurance department; g) Develops and approves strategic development plan of the Academy; h) Upon request of Deans of faculties approves scientific and research programs and curricula; i) Upon request of Deans of faculties, or authorized administration staff member, reviews issues related to disciplinary measures or expulsion of students and submits recommendations to the President of the Academy; k) Establishes terms of recognition of scientific degrees awarded by the other institutions of higher education; l) On the basis of request submitted by faculty, awards the degree of honorary doctor; m) On request of the Quality Assurance Department, approves the terms of evaluation of educational and scientific research works; n) Conducts other activities authorized by the Charter set forth; o) Submits recommendations on any issues related to development of the Academy; p) Secretary is obliged to write protocols of meetings, list the attendees and put down opponent’s views. 7. Decisions made by the Advisory Board are of recommendation character 8. Board meetings are initiated by: a) The Chairman of the Board; b) Request from al least three (3) members of the Board. Chapter IX Faculty and Faculty Council 1. A Faculty is the basic educational unit of the Academy. The faculty may be comprised of the teaching, research (Chair, scientific-research institute, laboratory, clinic, program trends, etc.) and support (library and other) structural units; 2. Faculty Council can be created as the representative body of a faculty, which consists of all the academic personnel of the faculty; 3. Faculty Council (Authority) a) Upon the Dean’s proposal, develops and presents the structure and the statute and produces to the President of the Academy for approval; b) Upon the Dean’s proposal, develops and presents to the President of the Academy for approval faculty’s strategic development plan, study and research programs, cultural and sports programs; c) Identifies the undisciplined students and presents them to the Advisory Board for taking further disciplinary action; 4. Until creation of the Advisory Board, Dean of the Faculty is in charge for taking actions on behalf of the Faculty Council. Chapter X Faculty Dean 1. A Dean is hired by the President of the Academy on contractual basis. 2. Faculty Dean a. Ensures efficiency of study and research activities at the faculty; b. Presents to the Faculty Council the faculty’s strategic development plan, and study and research programs; c. Develops and presents to the Advisory Board for approval the faculty structure and the statute; d. Within his/her competence, is responsible for the implementation of the decisions of Ruling Council and Faculty Council; e. Within his/her competence divides the functions and work among the academic personnel inside the faculty. Dean issues directives and decrees. f. Chairs the sessions of the Faculty Council; g. Is responsible for the proper spending of the faculty’s budget funds in compliance with this constitution in case of absence of it. 3. Implements systematic monitoring and evaluation of academic and research activities of the Academy as well as upgrading the personnel qualifications by introducing/using the international standards and methodologies. 4. Promotes high quality education by introducing modern methods of teaching, learning and evaluation (modules, credit systems, etc.) and prepares self-evaluation for the accreditation process. Chapter XI Quality Assurance Service 1. Quality Assurance Service ensures systematic monitoring and evaluation of academic and research activities of the Academy as well as upgrading the personnel qualifications by introducing/using the international standards and methodologies. 2. Quality Assurance Service promotes high quality education by introducing modern methods of teaching, learning and evaluation (modules, credit systems, etc.) and prepares self-evaluation for the accreditation process. 3. The head of quality assurance service supervises the compliance of academic process with the acting norms and standards. Presents report concerning current situation and also recommends perspectives of the further development to the council. Chapter XII Transitional Provisions The Constitution enters into force from the moment of signature by the President of the Academy. Changes made in the Constitution are approved by the decree of the Academy President. |
